ComfyCurve Terms of Service.

These Terms govern your use of the ComfyCurve website (comfycurve.co.za) and any purchase you make through it. By using the site or placing an order, you agree to these Terms.

Read them. They're not long.

About us.

ComfyCurve (Pty) Ltd (registration number 2026/115500/07) is a private company registered in South Africa, with its registered office at 24 Korhaan Street, Southdowns Residential Estate, Centurion, Gauteng, 0157. This is not a retail or returns location.

In these Terms, "ComfyCurve", "we", "us", and "our" refer to ComfyCurve (Pty) Ltd. "You" and "your" refer to you, the person using the site or placing an order.

Who can use the site.

Our site is intended for adults 18 years and older. By using it, you confirm that you're at least 18, that the information you give us is accurate, and that you're entitled to make purchases under South African law.

If you're using the site on behalf of a business, you confirm that you have authority to bind that business to these Terms.

What we sell.

We sell seamless shapewear designed for women. We currently make four pieces, available in the colours and sizes shown on each product page.

Product Images.

Our product imagery is created to represent each piece as accurately as the medium allows. The exact shade, trim, and finish of what you receive may vary slightly from what you see on screen, and screens themselves render colour differently. Minor variation of this kind is normal and is covered by our 30-day fit guarantee. This does not affect your rights under the Consumer Protection Act where an item is materially not as described.

Stock and availability.

We do our best to keep accurate stock information on the site, but availability can change quickly. If something you ordered turns out to be unavailable, we'll let you know within 2 working days and offer you the choice of waiting, swapping to another piece, or a full refund.

Pricing.

All prices are in South African Rand (ZAR) and include applicable taxes. Prices are reviewed regularly and can change. The price you pay is the price shown at checkout when you place your order.

Occasionally a product may be listed with an incorrect price due to a system error. If this happens, we reserve the right to cancel the order before it ships and refund you in full. We won't honour a price that's clearly the result of an error.

Placing an order.

When you complete checkout, you're making an offer to buy the items in your cart at the listed price. We accept that offer when we send you an order confirmation by email. That's the point a contract is formed between us.

We may decline an order before confirmation for any reason, including suspected fraud, payment issues, stock errors, or pricing errors. If we decline an order, we'll refund any payment in full.

Payment.

Payment is taken at checkout through our payment processor. We don't store your card details. Accepted payment methods are listed at checkout.

Shipping.

We ship within South Africa only. Delivery timelines, shipping costs, and tracking are explained on our Shipping page and Shipping Policy.

Returns and refunds.

Our return and refund terms are explained in full on our Returns page and Refund Policy. In short, you have 30 days from delivery to return a piece for a refund, store credit, or exchange. Different rules apply to change-of-mind returns versus damaged or defective items.

Consumer Protection Act.

Nothing in these Terms reduces, removes, or replaces any of the rights you have under the Consumer Protection Act 68 of 2008 (the "CPA"). Where any clause in these Terms conflicts with the CPA, the CPA applies.

Your account.

You can place orders as a guest or by creating an account. If you create an account, you're responsible for keeping your password secure and for any activity that happens under your account. Let us know straight away if you think someone else has accessed it.

Acceptable use.

When using our site, you agree not to:

  • Use the site for any unlawful purpose
  • Attempt to gain unauthorised access to any part of the site
  • Interfere with the site's normal operation
  • Use bots, scrapers, or automated tools to collect data from the site
  • Resell our products without our written consent
  • Misrepresent yourself or another person

We can suspend or terminate access to the site if we have a reasonable belief that you've broken these rules.

Our content.

The site's design, copy, imagery, logo, and product names are owned by us or licensed to us. You may not copy, reproduce, republish, or use any of it commercially without our written permission. Linking to our site or sharing our content on social media in the normal way is fine.

Your content.

If you post a review, send us a photo, or share anything else with us through the site or our email, you grant us a non-exclusive, royalty-free, worldwide licence to use that content for marketing and promotional purposes, with credit to you where appropriate. You confirm that anything you share is your own work and doesn't infringe anyone else's rights. You can ask us to stop using your content at any time by emailing info@comfycurve.co.za.

Reviews and feedback.

We welcome honest reviews. We don't filter, edit, or remove reviews simply because they're critical. We may remove reviews that are abusive, unlawful, or unrelated to the product.

Privacy.

How we handle your personal information is set out in our Privacy Policy. That policy is part of these Terms.

Third-party links and services.

Our site may link to third-party websites or use third-party services (like payment processors and couriers). We don't control those third parties and aren't responsible for their content, services, or terms.

Site availability.

We try to keep the site running smoothly but we can't guarantee uninterrupted access. We may suspend or change parts of the site at any time without notice. We're not liable for any loss caused by downtime, delays, or technical issues outside our reasonable control.

Limitation of liability.

To the maximum extent allowed by law, we're not liable for any indirect, special, or consequential losses arising from your use of the site or our products. Nothing in this clause limits any liability we have for death, personal injury, fraud, or anything else that can't legally be excluded.

Our maximum liability to you under these Terms for any single order is the amount you paid for that order.

Force majeure.

We're not liable for any delay or failure to perform our obligations under these Terms where the cause is outside our reasonable control. This includes things like natural disasters, load shedding, courier disruptions, strikes, civil unrest, government action, pandemics, and major IT outages.

Dispute resolution.

If something goes wrong, we'd prefer to sort it out directly. Email us at info@comfycurve.co.za with the details and we'll do our best to resolve it.

If we can't resolve it between us, either side may take the matter to the courts of South Africa with jurisdiction in Gauteng.

Governing law.

These Terms are governed by the laws of South Africa.

Changes to these Terms.

We may update these Terms from time to time. The current version will always be on this page, with the last updated date below. Material changes will be notified by email to anyone with an account, or by a notice on the site.

Severability.

If any part of these Terms is found to be unenforceable, the rest stays in force.
